Q8 — Eli Lilly

Is Lilly facing new lawsuits over insulin?

Yes — the federal multidistrict litigation had 416 pending cases as of mid-2025, and Florida's September 2026 suit extends the rebate theory to GLP-1 products, signalling states may apply insulin-pricing logic to the far more lucrative obesity drug market.

Yes. The insulin litigation has broadened rather than narrowed. As of mid-2025, 416 lawsuits were pending in the federal multidistrict litigation over insulin pricing, brought by states, counties, cities, school boards and self-funded employers.

In September 2026 Florida's attorney general sued Lilly, Novo Nordisk, Sanofi and the three largest PBMs, alleging violations of the state's deceptive trade practices and antitrust laws and seeking restitution and penalties. That complaint also reaches GLP-1 products including Trulicity and Ozempic, signalling that states may apply the insulin rebate theory to the newer, far more lucrative diabetes and obesity drugs. Lilly denies wrongdoing and argues that its current insulin prices are among the lowest in the market.
