How has Lilly been implicated in the insulin pricing controversy?
A Senate investigation found Lilly and rivals raised insulin prices in lockstep; internal documents showed executives were sensitive to PBM rebate economics; and Florida's 2026 lawsuit alleges Lilly returns roughly $210 of every $280 Humalog vial to PBMs as rebates.
A two-year Senate Finance Committee investigation, published in 2021, found insulin list prices had doubled or tripled in a decade without meaningful improvements in the drugs, and that executives at Lilly and Novo Nordisk were sensitive to the fact that PBMs earn money from rebates and fees linked to list prices. When the FTC sued the three largest PBMs in 2024, its competition bureau said it remained deeply troubled by the role of Lilly, Novo Nordisk and Sanofi and could sue manufacturers in future.
Florida's September 2026 lawsuit alleges Lilly returns roughly $210 of every $280 Humalog vial to PBMs as rebates and discounts. Lilly is also a defendant in a federal multidistrict litigation with hundreds of cases.
